Applicable to the entire site of Kernschrott-Recycling UG. In force since 1 July 2015.
In addition to the statutory provisions, these site rules and the Straßenverkehrsordnung (StVO – German Road Traffic Regulations) apply to the users of the company premises.
These site rules apply to the entire premises of Kernschrott-Recycling UG, comprising the areas shown on the site plan.
The facility is operated in particular on the basis of the following legal provisions, as amended from time to time:
1. Gesetz zur Förderung der Kreislaufwirtschaft und Sicherung der umweltverträglichen Bewirtschaftung von Abfällen (KrWG – German Closed Substance Cycle Waste Management Act)
2. Bayerisches Abfallwirtschaftsgesetz (BayAbfG – Bavarian Waste Management Act)
3. Bundes-Immissionsschutzgesetz (BImSchG – German Federal Immission Control Act), including the BImSch ordinances
4. Abfallverzeichnis-Verordnung (AVV – German Waste Catalogue Ordinance)
5. Verordnung über die Nachweisführung bei der Entsorgung von Abfällen (NachweisV – German Ordinance on Record-Keeping for Waste Disposal)
6. The BImSchG permit issued by the City of Regensburg on 8 February 2012 for the construction and operation of a scrap and metal trading business for the storage and treatment of hazardous and non-hazardous waste
7. All further laws, ordinances, accident prevention regulations, technical codes of practice, safety rules and occupational health provisions applicable to waste management companies
The company maintains an operating manual and site rules. Operations are governed by the organisation chart and by procedural and operating instructions.
1. The staff deployed in the operating areas and the management are responsible for proper and smooth operations.
2. Staff and management are authorised to give instructions to users of the facility.
3. Instructions must be followed. They take precedence over all other rules, such as traffic signs.
1. The site may be entered and driven on only by site staff, the management, authorised users (for example persons delivering material) and other authorised persons. Exceptions require prior consultation with the management.
2. Persons delivering material must report to the site staff; the member of staff concerned will give the briefing. Material must not be unloaded without reporting first.
3. Access is permitted only within the opening hours laid down and only in the areas assigned.
4. Persons delivering material must conduct themselves so that safety, order and operations are not disrupted and other persons are neither harmed nor endangered. The roadways and traffic routes must be used as instructed.
5. Smoking and the handling of open flames are prohibited in the marked areas.
6. Vehicles, receptacles and containers may be parked and placed only in the areas provided for this purpose.
7. The provisions of the StVO apply on the site. Speed must be adapted to the condition of the roadway and is limited in accordance with the signs.
8. Representatives of the authorities have a right of access during opening hours. They must report to the management and will be accompanied by the management or by an authorised member of staff.
For orderly disposal, users must observe the incoming inspection, at which the waste is examined and its quantity determined. Beyond that, the site staff determine which further facilities shown on the site plan are to be used.
1. Waste must be delivered on the basis of the provisions and requirements of waste legislation.
2. A confirmed disposal certificate or collective disposal certificate, including valid consignment notes, must be presented for every delivery of hazardous waste.
3. Where a declaration analysis is required, the waste producer or collector must present it before delivery.
4. In the delivery area, the delivery documents are checked and the identity of the waste is verified. Where waste is delivered in closed containers, the identity check is carried out at the unloading point.
5. Site staff and the management are entitled and obliged to take samples of the delivered and tipped waste in the entrance area and to have them analysed by an accredited laboratory – only where deviation from the declaration is suspected.
6. In the case of waste that does not correspond to the declaration in the disposal certificate, the matter must be clarified with the person who signed the declaration of responsibility. If the waste may be stored temporarily, it may be accepted. The occurrence must be documented in the operating logbook; any additional analysis of the type and composition is carried out at the expense of the party responsible.
7. Once the incoming inspection has been completed without objection, the unloading point is assigned – by staff or by signs.
8. Before leaving the site, you must report to the member of staff responsible. The driver receives a document showing the data recorded.
9. Waste may be unloaded and discharged only in the presence of the site staff or the management. At the unloading point the load is checked and, where necessary, a sample is taken.
1. Once cleared, the person delivering the material must drive to the unloading point assigned and unload there in the presence of the staff and as instructed by them.
2. If the visual inspection reveals waste that rules out proper acceptance, the unloading process is interrupted and the further procedure is determined.
3. The costs arising are borne in principle by the person delivering the material.
4. Users of the unloading points may leave their vehicles only for work that is necessary to unload the waste.
5. After unloading, the person delivering the material must leave the site immediately.
Only the types of waste contained in the current positive catalogue may be delivered to the installation. The positive catalogue forms part of the BImSchG permit.
1. Persons delivering material use the site at their own risk within the statutory framework.
2. Delivery vehicles, including containers, must be equipped so that waste cannot be lost or blown off on the way to the unloading area.
3. In terms of design and loading, vehicles must be able to reach the tipping points assigned and to leave them again without outside assistance.
4. Persons delivering material must drive only on the traffic routes and areas assigned.
5. The driver is responsible for positioning and unloading the vehicle safely in accordance with BGV D 29 (VBG 12) (German accident prevention regulations for vehicles).
6. Appropriate caution must be exercised when working machinery approaches, and you must stop where necessary.
7. The accident prevention regulations and state occupational safety provisions applicable to the site staff apply accordingly to users as well.
8. Users are liable for all damage caused to the company or to third parties by failure to observe the applicable provisions and these site rules – including damage caused by the delivery of waste that is not permitted under the BImSchG permit.
9. The company is liable only for damage caused intentionally or through gross negligence by its site staff or the management.
10. If a person delivering material breaches the site rules repeatedly or seriously, the company may refuse access by vehicle or on foot in writing, either for a specified period or permanently.
1. The alarm plan applies; it is located in the entrance area. Staff and the management are equipped with telephones so that notifications can be transmitted in accordance with the notification scheme. Emergency exits and fire service access routes must be kept clear.
2. Fire protection and first aid equipment is provided at the designated points.
3. Accidents and injuries must be reported to the staff or the management so that appropriate care can be arranged.
The associated document is the positive catalogue of waste approved for acceptance, as amended from time to time.
These site rules came into force on 1 July 2015 and are updated as required. The opening hours are displayed at the entrance gate.
